Short Range Devices (SRD) has to comply with regulations of Ministry of Information and Communications of Vietnam (MIC Vietnam) and required MIC Type Approvals, MIC import license, and Declaration of Conformity (DoC) to access Vietnam market.
1. APPLICABLE REGULATIONS
Procedures and documents required to obtain Type Approval certificate and letter of Acceptance of the Declaration of Conformity (ADoC) are regulated by the following regulations of MIC Vietnam:
Circular 42/2016/TT-BTTTT : Takes effect and replaces the Circular 05/2014/TT-BTTTT from October 01, 2017.
Document 886/BTTTT-KHCN : Official guidance of MIC Vietnam for implementation of Circular 42/2016/TT-BTTTT
Circular 46/2016/TT-BTTTT : Regulations on list of license-free frequency bands.
Other national technical regulations on EMC and RF issued by MIC Vietnam: Regulated by Circular 42/2016/TT-BTTTT, applicable regulations on EMC and RF will be based on type of SRD and operating frequency bands.
Important notes:
– WLAN and BT devices are not categorized in SRDs group of Appendix I of Circular 42/2016/TT/BTTTT)
– Operating frequency bands and RF output power of SRDs must comply with Circular 46/2016/TT-BTTTT. Importing and manufacturing SRDs which doesn’t meet the requirements of Circular 46/2016/TT-BTTTT is forbidden.
– SRDs are regulated by item 2.4 of Circular 42/2016/TT/BTTTT, therefore SRDs are not regulated by to “60mW rule”. Type Approval is required for SRDs regardless how small the output power is.
FAQs
Q: What are the Vietnam certificates required for Short Range Devices? What Authority issue? Certificate validity period?
A: Viet Nam Telecommunication Authority (VNTA) of MIC Vietnam verifies application dossiers and issues Type Approval Certificates for applicant. After obtaining Type Approval Certificates, certificate holders has to submit dossiers for letter of Acceptance of Declarations of Conformity (ADoC) or MIC Import license for customs clearance. Type Approval Certificate valid for 2 years since issuance date.
Q: Is Type Approval is mandatory for SRDs with maxium RF output power lower than 60mW?
A: SRDs is not regulated by “60mW rule” and subjected to mandatory MIC/VNTA approvals regardless maxium RF output power is lower than 60mW or not.
Q: How do we find the list of MIC Vietnam recognized MRA laboratories?
A: We can find the list of MIC Vietnam recognized MRA laboratories on official website of MIC Vietnam:https://english.mic.gov.vn/
Q: Our existing reports were issued by a MIC recognized MRA laboratory. Why does VNTA reject it?
A: MIC Vietnam recognizes a certain laboratory for certain national regulations for a certain period of time. VNTA shall reject your reports if it is not fallen within the scope of recognition.

Q: What shall we do if we don’t have appropriate reports issued by MIC recognized MRA laboratories?
A: In this case, test report issued by local laboratories designated by MIC Vietnam is suggested for faster certification procedures.
Q: Do we need to send samples for local testing?
A: One (01) sample is required for testing at Vietnam local laboratories.
Q: What are the highlighted changes for SRD approvals when the Circular 42/2016/TT-BTTTT take effect from October 01, 2017?
A: New regulations will be applicable for RFID, radio detection and alarm device, UWB device, radio access in 60 GHz band device, and several more changes.
Q: On October 01, 2017, do we have to renew our existing SRD type approval certificates?
A: It is not mandatory. Existing SRD type approval certificates remains its validity till expiry date.
Q: When can we apply for Type Approvals under regulations of the new Circular 42/2016/TT-BTTTT?
A: Application dossiers in accordance with the Circular 42/2016/TT-BTTTT will be accepted by VNTA from October 01, 2017.
